GENERAL CONDITIONS OF SALE

ARTICLE - 1 - GENERAL

The present general conditions of sale apply to all sales of equipment by the company LIGHT & DOMOTIQUE - 481 chemin de la Garenne 34560 POUSSAN, hereinafter referred to as the "seller" for the benefit of companies and various customers, hereinafter referred to as the "buyer". The fact of placing an order implies the full and entire adhesion of the buyer to the present general conditions. These terms and conditions shall prevail over any general terms and conditions of purchase and/or any other specific document issued by the buyer. If one of the clauses of the present general conditions of sale were to be null and void, the other clauses would not be nullified.

ARTICLE - 2 - ORDER

Any order can be formulated in writing or by any usual commercial means (e-mail, website) approved by the seller. The order must mention, in particular: the quantity, the brand, the type, the references, the agreed price, the terms of payment, the place and date of delivery or collection if it is other than the place of invoicing. Once the order is accepted by the seller, it is deemed to include the agreement of both parties on the item and the price, in the sense of Article 1583 of the Civil Code.

ARTICLE - 3 - PRICES

The prices invoiced are those established on the day of the order on the basis of the economic conditions in force. They may vary if the order is placed after the 7 days of validity of the basket established by the buyer. The prices are €TTC and the transport costs are increased by the VAT and/or all other taxes in force. The price of certain articles being likely to vary according to the fluctuations of the exchange rates, the taxes and/or the tariffs of the manufacturer, the parts agree in such a case, that the purchaser will support the increase of right if this one does not exceed 5%, the purchaser will have eight days after the reception of the mail or the email with acknowledgement of delivery informing him of this increase, to cancel his order.

ARTICLE - 4 - DELIVERY

The principle: the delivery is carried out by the salesman with the risks and dangers of the purchaser, with the address indicated by the purchaser at the time of the order, subject to the respect of the methods of payment.

Shipping: delivery is made by a carrier appointed by the seller, at the risk of the buyer, at the address indicated by the buyer when ordering, subject to compliance with the terms of payment. The buyer shall in such a case verify, upon receipt of the delivery, the number and condition of the materials delivered. In the event of damage or deterioration, he must make the usual reservations on the delivery note and inform the carrier within the time limit set by the latter, by registered letter with acknowledgement of receipt.

The lack of conformity of a part of the delivery does not exempt the buyer from his obligation to pay the materials for which there is no dispute.

Delivery charges are based on the rates given by the company making the delivery to the client, unless a specific condition is accepted by LIGHT & DOMOTIQUE.

ARTICLE - 5 - DELIVERY TIMES

Delivery times are always communicated according to supply possibilities at the time of the offer and are given as an indication only.

The seller shall use its best endeavours to deliver orders as soon as possible and shall not be liable to the buyer or to third parties for any direct or indirect damage whatsoever, including loss of profit, resulting from the failure or refusal to fulfil an order, from any delay in delivery or from any error in the execution of an order, whatever the reason.

However, if the delivery of the material has not taken place 60 days after the indicative date of delivery, for any other reason than a case of force majeure, the sale may be terminated at the request of either party after sending an email with acknowledgment of receipt, or registered letter with acknowledgment of receipt. The purchaser shall then only be entitled to a refund of the total amount of the order placed on the LIGHT & DOMOTIQUE website, without any other compensation.

Any delay in delivery due to a case of force majeure shall result, at the parties' option, in either the outright termination of the sale or the extension of the delivery period, without the parties being entitled to claim any other compensation.

The seller shall inform the buyer in due time of cases of force majeure. In any case, delivery within the time limits can only take place if the buyer has fulfilled all his obligations towards the seller.

ARTICLE - 6 - FULL PAYMENT

The customer must pay the totality of his order in cash if he wishes that the sending or the programming of his parcel is carried out. Payment will be considered only after actual receipt of funds.

The seller reserves the right to terminate or suspend current orders and deliveries in case of non-payment, or partial payment, on the due date.

 

ARTICLE - 7 - GUARANTEE - SCOPE

The warranty is always the one expressed by the manufacturer of the products in the instructions attached to the products. This guarantee covers all hidden or apparent defects from the date of delivery.

The work resulting from the warranty obligation is carried out

In the workshops of the manufacturer, by simple procedure, the purchaser must return the products concerned to the premises of Light et Domotique N°481 chemin de la garenne 34560 Poussan France, shipping/return at the expense of the purchaser.

The buyer cannot claim any compensation for direct or indirect damages resulting from the immobilization of the equipment due to the application of the warranty.

ARTICLE - 8 - WARRANTY - LIMITS AND EXCLUSIONS

The following are excluded from the warranty: the cleaning and routine maintenance of the equipment defined in the user manuals as being the responsibility of the user, as well as the supply of the products necessary for these operations. The purchaser will lose the benefit of the legal and conventional guarantees in particular in case of

- Abnormal or abusive use of the equipment,

- Repair or any interventions carried out by persons not approved by the manufacturer,

- Water damage, electrical surge, lightning or damage to the equipment resulting in particular from collision, falling materials, chemical aggression, fire, vandalism or malice,

- Deterioration or accidents resulting from an error of handling or lack of supervision or maintenance,

- Premature deterioration due to wear and tear or anomalies not reported to the manufacturer in time.

The seller may ask the manufacturer to suspend the legal and conventional guarantees in case of delay or total or partial non-payment of the material. No responsibility of the seller can be sought for losses and damages, direct or indirect, caused by the breakdown or defect of the equipment.

 

ARTICLE - 9 - WITHDRAWAL PERIOD

The consumer has a period of fourteen calendar days to exercise his right of withdrawal, without having to justify the reason or bear penalties. This period begins with the delivery of the last article ordered by the consumer.

A contact with our company at the email address: contact@light-domotique.fr, or at the number 06 74 77 76 24 (only by call) must be established so that we can allow you to exercise this right.

The return costs are charged to the customer who ordered on the site https://www.light-domotique.fr/ or https://www.light-domotique.com/

In accordance with Article L121-21-8 of the Consumer Code, the right of withdrawal can not be exercised on products: "Supply of goods made to the specifications of the consumer or clearly personalized.

 

ARTICLE -10- TRADE-IN CONDITIONS

As the products in the "home automation", "security" and "audio" categories are intended to be programmed and connected to different devices and voltage sources, LIGHT & DOMOTIQUE shall in no way be held responsible for incorrect connections and their consequences. LIGHT & DOMOTIQUE will therefore not accept any returns of products in the above-mentioned categories.

The 3 conditions of return to be respected:

 -Return and request for return within 15 days after purchase.

 -The product must be in factory KNX version (15.15.255).

 -The original packaging must be in perfect condition and complete.

 -The product must be free of any electrical connections.

After return of the products and verification in the premises of L&D, if everything is in order, the return can be made in the form of a refund or promotional code (usable for future orders on L&D) of the amount of the value of the products.
